User Agreement

This User Agreement (“Agreement”) governs your access to and use of the healthcare service platform operated by KSHITI Ayurveda, with its principal office at Coimbatore, Tamil Nadu, India (“Company,” “we,” “our,” or “us”). By accessing or using https://kshitiayurveda.com or any of its subdomains (“Platform”), you agree to be bound by the terms of this Agreement. If you do not agree, discontinue use immediately.

1. Nature of the Service

• The Platform facilitates healthcare services including doctor consultations (online, offline, chat, audio, and video consultations), treatments and procedures, and dispensing of Ayurveda medicines (“Services”).
• All medical advice, consultations, and treatments are provided solely by qualified healthcare practitioners (“Practitioners”) engaged or empanelled with the Company.
• The Platform does not replace the need for in-person medical care, particularly in emergency or life-threatening situations.

2. User Responsibilities

By using the Platform, you agree to:

• Provide accurate, current, and complete personal information during registration and at all times.
• Use the Platform solely for lawful, health-related purposes.
• Not rely solely on online consultations for critical, emergency, or life-threatening conditions. In such cases, you must seek immediate care at an appropriate healthcare facility.
• Acknowledge that online consultations have limitations and do not substitute detailed physical examination and diagnostics where necessary.
• Understand that any advice received via the Platform is for your personal health management and should be validated during in-person visits when required.

3. Account Registration and Security

• You must register an account with a valid phone number, email, and other information as requested.
• You are solely responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities conducted under your account.
• In case of any unauthorized account usage or security breach, notify us immediately at hi@kshitiayurveda.com.

4. Advisory, Services, and Payments

• The Platform may offer both free and paid consultations, procedures, and medicine orders. Specific pricing and coverage will be indicated during booking or purchase.
• Payments for paid Services are processed through our integrated payment systems. All payments are final and non-refundable, except in cases of technical error or Practitioner unavailability.
• The Company may retain a service fee or commission from paid Services as communicated during the transaction.

5. Medical Disclaimer

• The Platform and Company do not guarantee a medical diagnosis, prescription, or cure via online channels.
• The Company does not endorse, verify, or guarantee the advice or treatment provided by Practitioners beyond confirming their qualifications.
• Users are responsible for their health decisions and are encouraged to consult a qualified medical professional for serious or urgent health concerns.
• The Company shall not be liable for adverse effects or complications arising from reliance on advice or treatment received via the Platform.

6. Termination and Suspension

• The Company reserves the right to suspend or terminate accounts for false information, misuse, unlawful activity, or violation of this Agreement or applicable law.
• Users may request account termination at any time by writing to hi@kshitiayurveda.com.

7. Data Privacy and Security

• Personal data is collected, processed, and protected in accordance with our Privacy Policy available on the Platform.
• User data may be shared only for service-related operations (e.g., with Practitioners, payment processors) and not for unrelated third-party purposes.
• While security measures are implemented, no system is fully immune from breaches. Users should share sensitive health information online with appropriate caution.

8. Limitation of Liability

• The Company is not responsible for the completeness, accuracy, or effectiveness of any medical advice, consultation, or treatment provided by Practitioners.
• The Company is not liable for technical failures affecting platform access, communications, or transaction completion.
• Users agree to indemnify and hold KSHITI Ayurveda, its employees, directors, contractors, and agents harmless for any claims or damages arising out of misuse or improper reliance on Services provided.

9. Governing Law and Dispute Resolution

• This Agreement shall be governed by the laws of India.
• Disputes arising from this Agreement shall be resolved first through amicable negotiation; unresolved disputes shall be subject to the jurisdiction of courts in Coimbatore, Tamil Nadu, India.
• Users agree to comply with all applicable Indian laws and regulations, including those governing data privacy, health, and consumer protection.

10. Amendments and Modifications

• The Company reserves the right to amend or modify this Agreement at any time.
• Continued use of the Platform after such changes constitutes acceptance of the updated terms.
