Patient responsibilities and privacy commitments

Applicable to all users of KSHITI Ayurveda Virtual Consultation Platform

By accessing, booking, or participating in a virtual consultation via the KSHITI Ayurveda platform (“Platform”), you acknowledge, understand, and agree to the following Terms & Conditions. These terms apply to all video, audio, chat-based, and telephonic consultations facilitated through the Platform.

1. Eligibility & Representation

  1. You confirm that you are above 18 years of age and legally competent to enter into a healthcare consultation agreement.
  2. If you are booking or attending the consultation on behalf of a minor or a differently-abled individual, you confirm that you are their parent, legal guardian, or duly authorized caregiver.
  3. For minors/differently-abled patients, the RMP (Registered Medical Practitioner) may proceed only if the patient is present along with the caregiver during the virtual session.

2. Nature of Virtual Consultation

  1. You understand that a virtual consultation cannot replace an in-clinic physical examination.
  2. The services provided via the Platform are intended for non-emergency, non-acute medical conditions only.
  3. If you require emergency or urgent medical attention, you must immediately seek help at the nearest hospital or emergency center.

3. Accuracy & Responsibility of Information Provided

  1. You confirm that all personal, medical, diagnostic, and historical details (“Information”) shared with the RMP are true, complete, and accurate.
  2. You agree to provide additional information, documents, photographs, videos, or reports if requested by the RMP.
  3. Incomplete or incorrect information may lead to suboptimal diagnosis or treatment, for which neither the RMP nor KSHITI Ayurveda shall be liable.

4. Professional Discretion of the RMP

  1. The RMP holds full discretion to:
  • Assess whether a virtual consultation is appropriate,
  • Provide or decline diagnosis or prescription,
  • Request further investigation,
  • Recommend an in-person consultation,
  • Refer you to another specialist or facility.
  1. The RMP may discontinue the virtual consult if:
  • Information is insufficient,
  • The condition appears inappropriate for teleconsultation,
  • Technical or professional limitations arise.

5. Basis of Diagnosis, Limitations & Liability

  1. The RMP’s opinion, diagnosis, and prescription are based solely on:
  • Details provided by you during the consultation,
  • Reports, images, videos, or medical history uploaded by you.
  1. KSHITI Ayurveda and its doctors are not liable for:
  • Misdiagnosis arising from incomplete, incorrect, or misleading information,
  • Technical failures such as poor connectivity, device malfunction, or platform downtime,
  • Delays in consultation due to emergencies, prior appointments, or unavoidable circumstances,
  • Misinterpretation of advice by the patient.
  1. Virtual consultations inherently carry limitations, including but not limited to:
  • Inability to perform physical examination,
  • Reduced visual/audio quality,
  • Limitations in assessing signs requiring direct contact.

6. Patient’s Responsibilities

You agree to:

  1. Follow the RMP’s advice, prescription, dietary and lifestyle recommendations carefully.
  2. Arrange follow-up or in-person consultations when advised or when your condition worsens.
  3. Seek emergency medical attention if symptoms escalate or become life-threatening.
  4. Ensure proper internet connectivity and equipment for the session.
  5. Use your own account and not share login credentials with others.

7. Data Handling, Privacy & Consent

By using the Platform, you expressly consent to:

  1. Collection, use, storage, and processing of your personal and medical information by KSHITI Ayurveda and its authorized partners.
  2. Communication via phone, email, WhatsApp, video, or any digital medium by our doctors or representatives.
  3. Recording, storing, and retrieval of consultations (audio/video/chat) for medical, legal, and quality purposes, as allowed under applicable law.
  4. Secure sharing of prescriptions, reports, or health data with:
  • Pharmacies for medicine delivery (if opted),
  • Diagnostic partners for lab tests (if opted),
  • Internal clinical teams for continuity of care.

KSHITI Ayurveda endeavors to maintain strict data privacy and security. However, rare and unavoidable risks such as data breaches, unauthorized access, or cyber-incidents may occur despite reasonable safeguards.

8. Booking, Scheduling & Cancellation

  1. Consultation time slots are indicative; actual timing may vary due to clinical exigencies.
  2. Appointments may be rescheduled or cancelled in case of:
  • Technical issues,
  • Network failure,
  • Doctor emergencies or unforeseen delays.
  1. You are responsible for ensuring:
  • Stable internet connectivity,
  • A functional device with audio/video capability,
  • Being present at the scheduled time.

Failure to be prepared may result in rescheduling or cancellation without prior notice.

9. Limitation of Liability

To the maximum extent permitted under applicable law, neither KSHITI Ayurveda nor its doctors, employees, or affiliates shall be liable for:

  • Errors in diagnosis due to technical limitations,
  • Delay or failure in service due to network issues,
  • Misinterpretation of medical advice by the patient,
  • Non-availability of medicines or tests in your region,
  • Adverse effects due to non-compliance with instructions,
  • Use of teleconsultation for emergency or critical conditions.

You are advised to use your discretion in acting upon the medical advice received virtually.

10. Indemnity

You agree to indemnify KSHITI Ayurveda, its doctors, and representatives against losses arising from:

  • Misleading, inaccurate, or incomplete information provided by you,
  • Misinterpretation or misuse of prescriptions or advice,
  • Failure to follow medical instructions,
  • Unauthorized use of your account or credentials,
  • Payment issues or fraudulent transactions.

11. Consent for Virtual Consultation & Health Services

By booking and attending a virtual consultation, you:

  1. Provide informed consent to receive medical advice via online/telecommunication modes.
  2. Acknowledge the inherent limitations of telemedicine.
  3. Authorize KSHITI Ayurveda to process your health data as required for service delivery.
  4. Agree to abide by all policies, terms, and updates published by KSHITI Ayurveda on its website/platform.

12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu, unless otherwise mandated by applicable law.

13. Modifications to Terms

KSHITI Ayurveda may update or modify these Terms at its discretion. Continued use of the platform after such changes constitutes acceptance of the revised Terms.

By continuing to use the KSHITI Ayurveda Virtual Consultation Platform, you acknowledge that you have read, understood, and agree to all the Terms & Conditions stated above.
