Terms and Conditions for Products and Services

1. Introduction

1.1. These Terms and Conditions (“Terms”) govern your access to and use of the healthcare services and related offerings provided by KSHITI Ayurveda, located in Coimbatore, Tamil Nadu, India (“we”, “us”, “our”), through our website www.kshitiayurveda.com, its subdomains, and any associated communication channels or platforms (collectively, the “Platform”).

1.2. By accessing, browsing, registering on, or otherwise using the Platform and/or availing any services, you (“you”, “user”, “patient”, “customer”) agree to be bound by these Terms, our Privacy Policy, and any other policies referenced here. If you do not agree to these Terms, you should not use the Platform or our services.

1.3. These Terms constitute a legal agreement between you and KSHITI Ayurveda in relation to your use of the Platform and the services offered through it.

2. Scope of Services

2.1. KSHITI Ayurveda provides Ayurveda-based healthcare services, which may include but are not limited to:

• Doctor Consultation
• Online Consultation (including chat, audio, and video)
• Offline/In-clinic Consultation
• Treatments and Procedures based on Ayurvedic principles
• Ayurveda Medicines and health products, where made available

2.2. The services are intended for general health, wellness, and Ayurvedic support. They are not a substitute for emergency care, in-person examination where needed, or any treatment required for life-threatening conditions. For any medical emergency, users must contact their local emergency services or visit the nearest hospital immediately.

2.3. Online consultations (chat/audio/video) are provided based on information shared by you. The accuracy, completeness, and reliability of any health advice depend on the information you provide. You are responsible for providing true, accurate, and complete information, including medical history, current medications, allergies, and past reports where relevant.

2.4. Ayurveda medicines and treatment plans may vary from person to person depending on prakriti (constitution), current health status, and other clinical factors. The same product or treatment may not be suitable for everyone. You must use medicines strictly as advised by the consulting doctor or as per instructions provided.

2.5. We may modify, add, suspend, or discontinue any service or feature on the Platform at any time, with or without prior notice, at our discretion.

3. User Eligibility and Account

3.1. You confirm that you are at least 18 years of age and legally competent to enter into a binding agreement under applicable laws. If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian, who accepts these Terms on your behalf.

3.2. To avail certain services (for example, online consultations, ordering medicines), you may be required to create an account by providing information such as name, contact details, and other relevant data. You agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential
• Be fully responsible for all activities that occur under your account

3.3. You agree not to use another person’s account or share your account with others. You will promptly notify us of any unauthorized use of your account or any other actual or suspected security breach.

4. Appointments, Consultations, and Use of Services

4.1. Booking and Scheduling:

You may book online or offline consultations through the Platform or other communication channels we specify. Appointment confirmation is subject to doctor availability and successful completion of any required payment.

4.2. Mode of Consultation:

Consultations may be offered via:

• In-person (offline) at our physical location(s)
• Online chat
• Audio call
• Video call

The exact mode of consultation for a particular service will be indicated at the time of booking.

4.3. Information and Records:

You may be asked to upload/share previous prescriptions, reports, or other medical records. By doing so, you authorize us and the consulting doctor to review such records for your care. You are responsible for ensuring that any documents or records you share are legible, correct, and up to date.

4.4. Adherence to Advice:

Any treatment plan, lifestyle recommendation, or medication advice given by our doctors is based on Ayurvedic principles and the information available at the time of consultation. You are responsible for:

• Following the prescribed dosage and regimen
• Reporting any side-effects or concerns promptly
• Informing your doctor about pre-existing conditions, pregnancy, or concurrent medications

Failure to follow medical advice or incomplete disclosure may affect the outcome and limits our liability.

5. Ayurveda Medicines and Products

5.1. Where we provide or recommend Ayurveda medicines or products, these may be dispensed:

• Directly by KSHITI Ayurveda, or
• Through third-party pharmacies or partners (where applicable)

5.2. Usage of any medicine must strictly follow:

• The advice of the consulting doctor, and/or
• The instructions provided on the label/package

Do not self-medicate or modify dosage without consulting a qualified professional.

5.3. Certain products may not be suitable for pregnant women, nursing mothers, children, elderly patients, or people with specific conditions (for example, kidney/liver disease, allergies). You must disclose such conditions to the doctor and carefully read all product instructions.

5.4. We do not guarantee any specific outcome or cure. Results may vary from person to person due to individual constitution and multiple factors.

6. Pricing, Payments, and Invoicing

6.1. Fees for consultations, treatments, procedures, and medicines will be indicated on the Platform or communicated at the time of booking/order. Prices are subject to change at our discretion.

6.2. Payments may be collected through:

• Online payment gateways (credit/debit card, UPI, net banking, wallets, etc.)
• Direct bank transfer or offline modes where explicitly allowed

6.3. You authorize us or our payment service providers to process transactions in accordance with the chosen payment method. You may be required to accept additional terms of the payment gateway or third-party provider.

6.4. All amounts are payable in Indian Rupees (INR), unless explicitly specified otherwise. Any taxes, levies, or charges applicable under law will be added and shown separately where required.

6.5. Once a payment is successfully made, you may receive a confirmation via SMS, email, or within the Platform. You are responsible for verifying the details and notifying us promptly in case of any discrepancy.

7. Refunds, Cancellations, and Rescheduling

7.1. Consultation Cancellations/Reschedule by User:

Policies regarding rescheduling or cancelling consultations (online or offline) will be as specified on the Platform or communicated separately. Time limits and charges (if any) may apply for:

• Cancellations made before a specified cut-off time
• No-shows or late arrivals
• Last-minute cancellation requests

7.2. Cancellations by KSHITI Ayurveda / Doctor Unavailability:

If a consultation or procedure is canceled or rescheduled by us or the consulting doctor due to unforeseen reasons, we may:

• Offer an alternative slot, or
• Provide a refund as per our then-applicable policy

7.3. Medicines / Products:

Given the nature of medicinal and healthcare products, returns or refunds may be restricted. Refunds or replacements may be allowed only for specific reasons such as:

• Wrong product delivered
• Damaged product received
• Other conditions as mentioned in our detailed refund/cancellation policy

Items once opened, used, or tampered with may generally not be eligible for return, except as required under applicable law.

7.4. Detailed and updated Refund and Cancellation terms (if published on our website) will form part of these Terms and shall prevail in case of conflict.

8. Health Advisory, Disclaimers, and Limitation of Liability

8.1. Information provided on the Platform, including articles, blogs, FAQs, and general wellness content, is for informational and educational purposes only. It does not replace in-person medical consultation, diagnosis, or treatment by a qualified practitioner.

8.2. While our doctors and practitioners will use reasonable skill and care, medicine and healthcare outcomes are inherently uncertain. You understand and agree that:

• No outcome, cure, or result is guaranteed
• Improvement or deterioration in health may depend on multiple factors beyond our control
• Non-adherence to recommendations can adversely affect outcomes

8.3. To the maximum extent permitted by applicable law, KSHITI Ayurveda, its practitioners, employees, agents, and affiliates shall not be liable for any:

• Indirect, incidental, consequential, or special damages
• Loss of data, loss of profits, or business interruption
• Damages resulting from misuse of services, incomplete disclosure of medical history, or failure to follow advice

8.4. We do not make any warranty that:

• The Platform will be uninterrupted, timely, secure, or error-free
• Any defects will be corrected promptly
• Any information obtained through the Platform will be accurate or reliable in all situations

9. User Obligations and Acceptable Use

9.1. You agree to use the Platform and services only for lawful purposes and in accordance with these Terms.

9.2. You shall not:

• Post, upload, or share any content that is defamatory, obscene, abusive, discriminatory, or otherwise unlawful

10.3. You shall not:
